stipulated work refers to the employee's original work, for the full scope of hours and without restrictions. This probably sounds familiar to you as an employer, but how does it work during absenteeism?
Modified work during reintegration, can your employee be reported recovered for this?
Together with your employee, you have agreed on the tasks that can be performed during reintegration. These tasks are not part of the original work and your employee cannot be reported recovered for this. If you do, your employee may see this as newly stipulated work and returning to the original work from before the absenteeism may be difficult to discuss.
When is newly stipulated employment?
As long as the modified work is performed during the period of reintegration and tested by the medical line, with the goal of starting to perform the original tasks, there is no new stipulated work. If a recovery report has been made without full performance of the original duties, this may eventually be seen as newly stipulated work. The length of time that modified work is considered as new contracted work varies. No clarity is given on this.
What can you do as an employer?
- Evaluate regularly with your employee. Are original tasks already possible or can the modified tasks be expanded? This is all possible during absenteeism. Put it in a plan of action and include the advice of the medical line in this. Your Labor and Health Advisor can connect during this conversation and advise both you and your employee on this.
- Do not report your employee better if he/she is not yet able to perform the original work fully.
- If the modified duties have become the new duties, this is the newly stipulated work. Put this in an agreement. This will avoid any noise between you and the employee.
Discuss stipulated employment with your Advisor
